Lateral Hire Will Strengthen Growing Practice and Help Rebuild London Office
Boies Schiller Flexner LLP today announced that Timothy L. Foden has joined the firm’s London office as a partner in the international arbitration group. With deep experience in investment disputes and commercial arbitration, Tim will bolster BSF’s firmwide capability for handling complex arbitration matters while helping to rebuild the London presence.
Known for his willingness to take on sovereign states on behalf of clients, Tim has significant experience handling investor-treaty and complex commercial arbitrations in the mining and energy sectors. For more than a decade, he has advised numerous investors in bringing claims under the Energy Charter Treaty and other bilateral investment treaties.
“The opportunity to join a platform like Boies Schiller and to be part of the process of rebuilding in London was a compelling combination for me,” Tim said. “The arbitration team is incredibly strong, in the U.S., London, and Milan, and my clients and cases will complement those strengths well. I am also looking forward to partnering with my new colleagues in London to further develop our presence in London and internationally.”
An American and British citizen who has worked on both sides of the Atlantic, Tim relocated to London in 2011 and has worked at both Magic Circle and international law firms. He helped to develop the arbitration practice at a U.S.-based firm in London and built the London office of a boutique arbitration firm from the ground up.
“The strengths Tim brings to our team – as a leading lawyer and culturally – are important contributions to our growth trajectory,” said London partner Prateek Swaika. “We are committed to maintaining a premium disputes resolution practice in the U.K. and are doing so in a purposeful way. Tim is a fantastic addition to the London team.”
Tim has acted in proceedings under the ICSID, ICC, SCAI, UNCITRAL, LCIA, and ICDR arbitration rules and has extensive experience in the enforcement of commercial and ICSID arbitration awards in the courts of the United States, England, and Belize.
London partner David Hunt said, “Boies Schiller has a long history of taking on challenging, complex arbitration matters and securing positive outcomes for our clients. Tim has consistently done the same in his practice. His expertise on arbitration matters involving mining and energy issues is second to none, and he brings tremendous skill and experience to our existing cases, as well as to new clients that we will develop together. I look forward to working with him.”
Boies Schiller’s international arbitration practice combines a business-oriented perspective with significant experience in trials, crisis management, economic and damages analysis, and international enforcement proceedings to pursue successful outcomes. We represent clients before all major arbitral institutions, including the ICC, LCIA, ICSID, ICDR, and VIAC, as well as in UNCITRAL and other ad hoc arbitrations.
“As we have evaluated opportunities to expand in London this year, we have remained focused on growing in a way that is fully integrated with the rest of the firm,” said Managing Partners Sigrid McCawley, Matthew Schwartz and Alan Vickery. “Tim has deep experience in an area of strategic importance for us, he has strong familiarity with both the U.S. and U.K. legal markets, and his proven ability to build an office in London brings tremendous value to our efforts there. In all respects, he is a great fit for what we are aiming to achieve in the U.K.”
Tim is an adjunct associate professor at the American University, Washington College of Law. He has been recognized as a rising star for international arbitration work by several industry publications. Tim speaks and publishes regularly on international arbitration topics. He began his legal career working for the U.S. Court of Appeals for the Eleventh Circuit in Atlanta, Georgia.
