Boies Schiller Flexner is calling on the Supreme Court to declare that the 12 regional Federal Reserve Banks are part of the U.S. government, not private corporations, in a dispute over payment verification patents, the National Law Journal reported.
Boies Schiller partner Scott Gant and associate Menno Goedman filed a petition for certiorari for patent holder Bozeman Financial after the Federal Circuit ruled in April that the banks are private corporations established by the federal government but not part of it, the National Law Journal Reported.
“The factors relied on by the Federal Circuit fail to support its conclusion that the Banks are ‘distinct’ from the Federal Government, or the court’s holding that they are ‘persons’ under the AIA,” according to the petition.
