The Supreme Court denies remaining challenges to the historic $2.67 billion nationwide class action settlement against Blue Cross Blue Shield.
On Monday, June 24, 2024, the U.S. Supreme Court denied two petitions for certiorari from the only remaining objectors to the settlement in the case In re Blue Cross Blue Shield Antitrust Litigation. These rulings mark the final stage in the court approval of the settlement. In addition to the monetary award of $2.67 billion, which is one of the largest ever monetary settlements in a private antitrust case without government involvement, the settlement also includes significant injunctive relief that should improve competition in the health insurance market.
The settlement resolves civil antitrust claims by subscribers that Blue Cross Blue Shield Association and member plans conspired to drive up health insurance costs.
The BSF team representing the subscriber class includes David Boies, Hamish Hume, Adam Shaw, Alex Boies, and Eric Palmer.
