BSF partner Scott Gant was quoted in Bloomberg Law in an article about his representation of Phyllis Randall, the Chair of the Board of Supervisors for Loudoun County, Virginia, who was sued for briefly banning a constituent from her Facebook page.
Randall created her page before she was in office and she maintained it on her own, and Loudoun County wasn't involved with it in any way, Gant told Bloomberg Law. “Even public employees have the right to speak privately,” Gant said.
Gant is representing Randall in her appeal before the U.S. Court of Appeals for the Fourth Circuit, challenging a trial court judgment that she violated the First Amendment by banning the constituent from her Facebook page for less than 12 hours.
