Oral arguments have been scheduled for December 5, 2024, in the U.S. Court of Appeals for the First Circuit on a landmark case challenging the federal ban on marijuana.
The lawsuit, originally filed in the Federal District Court for Western Massachusetts, was brought by cannabis companies represented by BSF, including Verano Holdings, Canna Provisions, Wiseacre Farm, and Treevit CEO Gyasi Sellers, who argue that the federal marijuana ban is unconstitutional.
The appeal seeks to overturn a previous ruling by U.S. District Judge Mark G. Mastroianni, who dismissed the case in July, citing Supreme Court precedent that upheld federal cannabis prohibition. In that ruling, Judge Mastroianni conceded that there are “persuasive reasons for a reexamination” of the current scheduling of cannabis, and encouraged the plaintiffs to “pursue their claims and seek the attention of the Supreme Court.”
