Boies Schiller Flexner LLP today announced that veteran employment and workplace safety and health litigator Benjamin J. Kim has joined the firm as a Los Angeles-based partner.
“Boies Schiller’s ability to take on and achieve success in complex, high-impact litigation and to deliver creative, efficient results to clients is consistent with how I have structured my own practice over the course of my career,” Ben said. “In the Los Angeles office and on the West Coast, we will continue to focus on delivering solutions to clients while providing our diverse legal talent with opportunities to take on challenging work. Those qualities are part of what makes Boies Schiller a unique place, and I am happy to be joining a firm that prioritizes client outcomes, leverages technology and rewards innovative strategies.”
Ben joins from an international AmLaw 100 firm where he was a leader of the firm’s nationwide labor and employment group and chaired its Occupational Safety and Health (OSHA) practice.
Recently, Ben litigated some of the country’s first COVID-19 cases and provided strategic counsel to a wide range of industries, including healthcare, during an unprecedented pandemic that kept workplace safety and health at the top of all employers’ minds. He also has focused on litigating harassment and discrimination cases involving high-level executives, nationwide and California-wide class and other representative actions, and executive contract and partnership disputes. He also has litigated theft of trade secrets, privacy and tort cases. To complement his litigation and trial practice, Ben has counseled and represented clients through a variety of internal and government agency investigations and audits.
“Ben’s proven track record as a skilled litigator and national practice group leader make him a valuable addition to the firm,” said Managing Partner Sigrid McCawley, who also leads the firm’s Partnership and Employment Disputes Practice. “Clients will benefit from his litigation experience and his familiarity representing companies in front of state and federal agencies.”
As part of his overall practice, Ben maintains an industry focus on entertainment and esports, which complements Boies Schiller Flexner’s Sports and Gaming practice. In addition to providing counsel on legal issues related to the rapidly evolving technology and business needs of these sectors, Ben has advised entertainment and esports organizations on a variety of workplace-related issues.
“With his strong background representing clients in California courts and before government agencies, Ben brings formidable local experience to our West Coast team,” said Los Angeles-based partner John Kucera. “Having led a national practice, Ben also brings tremendous and valuable experience to our clients across the country. We are thrilled to welcome him to the firm.”
Keeping in line with Boies Schiller Flexner’s dedication to providing access to justice to those in need, Ben maintains an active pro bono practice advising nonprofit organizations on employment and other issues.
Ben is also an active speaker on the latest labor and employment and OSHA developments and is scheduled to present on a speaking panel to discuss a recent U.S. Supreme Court decision regarding COVID-19 and workplace safety for the American Bar Association’s (ABA’s) Labor and Employment Law Conference in Washington, D.C., in November 2022. He also is an active member of the ABA’s Workplace & Occupational Safety and Health Law Committee and is involved in the National Asian Pacific American Bar Association and Korean American Bar Association.
Ben earned his J.D. from the University of California Berkeley School of Law and his B.A. summa cum laude from the University of Arizona.
“Ben Kim and I have known each other for our entire legal careers, since the days of Berkeley Law School,” said West Coast partner Mark Mao. “He brings the same level of dedication and creativity we are known for here, in addition to the commitment of giving back to the community. He will be a fantastic addition to our group at Boies Schiller.”
