Boies Schiller Flexner associate Edoardo Gandini published the article “The Enforcement of Arbitration Awards on Foreign State Property and Law Applicable to the Statute of Limitations of Ascertained Rights.”
The article addresses two important questions: “What are the criteria for qualifying property as state property?” and “What law applies to the statute of limitations for rights ascertained in an arbitration award?” To answer them, Edoardo analyzes a judgment by the Paris Court of Appeals dated July 6th, 2023, on two “evergreen” topics: (i) immunity of state property in the enforcement of an arbitration award and (ii) law applicable to the statute of limitations of rights established in the award.
