In June 2010, BSF completed a six-week trial defending the law firm of Proskauer Rose from a claim of professional negligence. The Plaintiff, a seller of fuel and other aeronautical services at the Boca Raton Airport, alleged that it was entitled to more than $65 million in lost profits as a result of what they claim was a defect in a lease agreement drafted by Proskauer. BSF successfully argued that the lease agreement, as Plaintiff alleged it should have been drafted, violated federal law and could not form the basis of an award. As a result, BSF obtained a directed verdict on one of Plaintiff’s two claims. The second claim resulted in a hung-jury and a retrial is scheduled for October of 2011.
